When can you reclaim ADS?
You can reclaim the Additional Dwelling Supplement if you sell your previous main residence within 18 months of buying your new home. Then you have 12 months from the date of that sale to submit your claim to Revenue Scotland.
The economic unit rule
Married couples and civil partners are treated as an “economic unit.” If either partner already owns residential property — anywhere in the world, including inherited property — ADS applies to any joint purchase. One partner's existing property triggers ADS even if the other partner has never owned before.
How to claim your refund
1. Sell your previous main residence within the 18-month deadline.
2. Complete an ADS reclaim form on the Revenue Scotland website.
3. Submit within 12 months of the sale date.
4. Revenue Scotland aims to process refunds within 10 working days (but warns it may take longer).
You can apply directly — you don't need your solicitor to do it. Some solicitors incorrectly tell buyers they can't claim independently.
